O principal objetivo deste artigo é estabelecer uma reflexão sobre os conceitos de justiça e contrato social na obra de Jean-Jacques Rousseau. Objetivo elucidar o lugar que essa problemática ocupa em seu pensamento, enfatizando como as desigualdades naturais entre os homens, minimamente consideradas por Rousseau, foram significativamente alargadas com o advento da sociedade. Devido à extensão da temática, limito a investigação ao estudo dos textos Discurso sobre a origem e os fundamentos da desigualdade entre os homens e Do contrato social. De posse destes meios, pretendo apresentar o momento em que Rousseau é impelido a pensar a ideia de justiça a partir da perspectiva contratualista.

The main objective of this paper is to establish a reflection on the concepts of justice and the social contract in the work of Jean-Jacques Rousseau. Objective To elucidate the role of that problem occupies in his thinking, emphasizing how the natural inequalities among men, minimally considered by Rousseau, were significantly expanded with the advent of the society. Due to the length of the theme, I limit the investigation to the study of speech texts on the origin and foundations of inequality among men and The Social Contract. With these means, intend to present the moment that Rousseau is impelled to think the idea of justice from the contractarian perspective.

O contrato social na perspectiva da matriz democrática deliberativa sob a óptica da ética discursiva e do paradigma dos direitos fundamentais / The social contract in the perspective of deliberative democratic framework from the perspective of discourse ethics and the paradigm of fundamental rights

O presente artigo tem como objetivo discutir o contrato social a partir das bases teóricas da democracia deliberativa que está ligada a ética discursiva. Para tanto, partiu-se da indagação acerca daspossíveis contribuições que a matriz da democracia deliberativa traz para o contrato social a partir do paradigma dos direitos fundamentais no constitucionalismo contemporâneo. Partindo-se de tal indagação busca-se primeiramente definir as questões preliminares fundamentais a compreensão do papel da linguagem a partir da reviravolta lingüística, para a posteriori discorrer sobre a ética discursiva enquanto orientação para a comunicação intersubjetiva, para, finalmente, expor pressupostos da democracia deliberativa como forma de identificar suas contribuições para o contrato social no constitucionalismo contemporâneo, calcado na lógica de reconhecimento e concretização dos direitos fundamentais. Dito isso, pode-se concluir que, a democracia deliberativa privilegia um ambiente intersubjetivo para a produção de consensos destinados a criar, proteger e concretizar direitos fundamentais, como verdadeiros paradigmas do neocontratualismo.

This article has the purposeof to discuss the social contract from the theoretical bases of deliberative democracywhat is united to the discursive etichs. It is questioned about the possible contributions that the matrix of deliberative democracy brings to thethe social contract starting the paradigm of fundamental rights in the contemporary constitutionalism. Starting from this question, firstly it has been sought to define the preliminary fundamental questions about the understanding of the role of language from the linguistic spinning , to a posteriori discuss about the discursive ethics as orientation for subjective communication, to, finally, to expose the assumptions of deliberative democracy like a way of identify its contributions to the social contract in the contemporary constitutionalism, supported by the logic of recognizing and achievement of the fundamental rights. That said, it is possible to conclude that the deliberative democracy privileges an intersubjective environment to the production of agreements destined to create, to protect and to achieve fundamental rights, as true paradigms of the neocontractualism.

Um olhar evolucionista para os mecanismos cognitivos associados às trocas sociais / An evolutionary view of cognitive mechanisms associated with social exchange

A psicologia evolucionista propõe uma investigação sobre as origens e os propósitos das habilidades cognitivas que constituem a cognição social humana. Este artigo procura apresentar a teoria do contrato social como um modelo evolucionista para o estudo de mecanismos cognitivos associados às trocas sociais e da cooperação, tais como: detecção de trapaça, memória de faces, senso de justiça, influência da informação e conhecimento prévio, vigilância e teoria da mente que regulam, fundamentalmente, nossas interações sociais. Conclui-se que um olhar evolucionista para a mente humana gera hipóteses, enquanto a teoria dos jogos fornece métodos para testá-las, nos auxiliando a compreender a natureza humana.

Evolutionary psychology proposes the investigation of the origins and purposes of cognitive skills that constitute human social cognition. This article presents the social contract theory as an evolutionary model for the study of the cognitive mechanisms and cooperation, such as cheating detection, memory for faces, sense of justice, the influence of prior knowledge and information, vigilance and theory of mind that regulate social interactions. It is concluded that an evolutionary view of human mind produces hypotheses, while game theory provides methods to test them, helping us to understand human nature.

O Sistema Único de Saúde como observatório de direitos universais: uma reflexão a partir das Ciências Sociais / The National Health System as an observatory for universal rights: a reflection based on the Social Sciences / El Sistema Único de Salud como observatorio de derechos universales: una reflexión a partir de las Ciencias Sociales

Há uma ampla bibliografia sobre a crise da modernidade. Uma certa vertente compreende que estão ameaçados vários pilares da vida social moderna, dentre eles as conquistas representadas pelos direitos universais. A literatura da Saúde Coletiva também aponta o Sistema Único de Saúde (SUS) como uma ocorrência contrária ao movimento mundial de flexibilização daqueles direitos. Os princípios de universalidade e integralidade, além de constituírem um desafio institucional, financeiro, político e social, expressam também a decisão da sociedade de implementar direitos universais. Utilizamos o instrumental teórico de Souza Santos para caracterizar o SUS como um observatório sobre a efetivação de tais direitos. Ressurge a importância do remodelamento institucional e das deliberações democráticas no estabelecimento do contrato social.

The bibliography on the crisis of modernity is wide-ranging. One particular school of thought takes the view that various pillars of modern social life are under threat: among them the achievements represented by universal rights. The public health literature also points out that the National Health System (SUS) is a development going against the worldwide movement towards flexibilization of these rights. The principles of universality and comprehensiveness not only constitute an institutional, financial, political and social challenge, but also express society's decision to implement universal rights. We have used Souza Santos's theoretical instrument to characterize SUS as an observatory regarding effective application of these rights. Institutional remodeling and democratic deliberations for establishing a social contract emerge again as matters of importance.

Hay una amplia bibliografía sobre la crisis de la modernidad. Cierta vertiente comprende que están amenazados varios pilares de la vida social moderna, entre los cuales las conquistas representadas por los derechos universales. La literatura de la Salud Colectiva también señala el Sistema Único de Salud (SUS) como una ocurrencia contraria al movimiento mundial de flexibilización de tales derechos. Los principios de universalidad e integralidad, además de constituir un desafío institucional, financiero, político y social, expresan también la decisión de la sociedad de implementar derechos universales. Utilizamos el instrumental teórico de Souza Santos para caracterizar el SUS como un observatorio sobre la efectuación de los derechos universales. Resurge la importancia de la remodelación institucional y de las deliberaciones democráticas en el establecimiento del contrato social.
